Gadget Guruz Technologies Pvt Ltd ("Company", "we", "our", "us") operates gadgetguruz.com and its associated mobile applications, offering device repair, buy/sell/recycle, doorstep technician services, e-waste management, and related enterprise products including SERKIT and PRAMAAN (collectively, the "Platform" or "Services").

These Terms of Use ("Terms") govern your access to and use of the Platform. They apply to all users including customers, registered account holders, service partners, technicians, enterprise clients, and website visitors.

These Terms are a legally binding agreement under the Information Technology Act, 2000, the Consumer Protection Act, 2019, and all other applicable laws of India. They are compliant with the Digital Personal Data Protection (DPDP) Act, 2023, read alongside our Privacy Policy.

Buyer	A User who purchases a product or service on the Platform.
Seller	A User or third-party vendor who lists products for sale on the Platform.
Service Partner / Technician	A registered repair technician or service partner on the Platform.
Order	A confirmed request for a repair, sale, recycle, buy, or technician booking.
Device	Any electronic device submitted for repair, testing, sale, or recycling via the Platform.
Certificate	A device health or QC report generated by PRAMAAN.
Saarthi	The Gadget Guruz AI support agent.

• You must be at least 18 years of age to create an account and use the Platform.
• You agree to provide accurate, current, and complete registration information and to keep it updated.
• You are responsible for maintaining the confidentiality of your login credentials (OTP, password, social login tokens) and for all activity under your account.
• Notify us immediately at support@gadgetguruz.com if you suspect unauthorised access to your account.
• We reserve the right to suspend or terminate any account found to have provided false information or to be in violation of these Terms.
• One person may hold one active account. Creating multiple accounts to abuse offers, referral programs, or dispute processes is prohibited.

Buy / Sell	Marketplace for purchasing and selling refurbished electronics.
Recycle	Responsible e-waste recycling and pickup service.
Doorstep Technician	On-demand certified technician dispatch for home visits.
SERKIT	Enterprise device management and AMC (Annual Maintenance Contract) services.
PRAMAAN	Hardware diagnostics and QC certification software.

We reserve the right to add, modify, or discontinue any service at any time.

• All orders and bookings are subject to acceptance by Gadget Guruz. We reserve the right to refuse or cancel any order at any time before service execution.
• Confirmation of an order (by SMS, email, or in-app notification) constitutes acceptance and forms a binding service agreement.
• Prices displayed are inclusive of applicable taxes unless stated otherwise and are subject to change without notice before an order is confirmed.
• For marketplace (buy/sell) transactions, Gadget Guruz acts as an intermediary platform. The contract of sale is between the Buyer and the Seller.
• Estimated service timelines are indicative and may vary due to device complexity, parts availability, or other factors beyond our control.

• Cancellations must be requested before the device or technician is dispatched. Once dispatched, cancellation is not possible.
• For Express Service bookings, a cancellation charge applies if you cancel after the technician has been assigned. The applicable charge will be disclosed at the time of booking.
• For marketplace (buy/sell) orders, cancellations may be requested before the order is shipped. Once shipped, the Return Policy in Section 8 applies.
• If a cancellation is accepted and payment has been made online, the refund will be processed to the original payment method within 5–7 working days.
• Gadget Guruz reserves the right to cancel an order at any time due to unavailability of service, parts, or technicians. In such cases, a full refund will be issued.

• We provide a warranty period on repairs as specified at the time of service (typically 30–90 days depending on repair type).
• We will attempt a re-repair up to twice after the initial repair. If the device remains faulty, we will issue a refund (minus applicable shipping/logistics costs).
• Refunds are not applicable for diagnostic-only services or water/liquid damage repairs, as outcomes cannot be guaranteed.
• The refund amount will be assessed at Gadget Guruz's discretion after a complete inspection. You will be notified before processing.
• Refunds will be credited to the original mode of payment within 5–7 working days of approval.

• Refunds for marketplace purchases are processed in accordance with the Return Policy in Section 8.
• If a Seller fails to fulfill an order, a full refund will be issued to the Buyer.
• Refunds are not issued for buyer's remorse where the product matches its listing description.

• Once a device is accepted for recycling, no refund or reversal is available.
• The valuation offered for recycling is final once accepted. Gadget Guruz reserves the right to revise the valuation after physical inspection if the device's condition differs from what was stated.

A "Return" is the action of sending back an item purchased on the Gadget Guruz Platform by the Buyer to the Seller. Returns may only be initiated within 3 days of the Buyer receiving the item, as verified by the logistics delivery record.

1. The item received was defective or faulty on arrival.
2. The item was damaged during shipping.
3. The item received was different from what was ordered (wrong item shipped).
4. One or more product components or accessories were missing.

• Contact us on 7838423438 (11 AM – 7 PM, Mon–Sat) or raise a return request through the Platform within 3 days of delivery.
• Provide your order ID, reason for return, and supporting photos/video where applicable.
• Our team will review your request and respond within 24 hours.

• If the Seller does not respond within 3 days, the refund will be automatically processed in favour of the Buyer.
• All shipping costs for accepted returns are borne by the Seller, not the Buyer.
• If the Seller rejects a return, the Buyer may raise a dispute via gadgetguruz.com/contact-us and invoke the Buyer Protection Program.

• A replacement request may be raised for the same reasons listed in Section 8.2 and within the same 3-day window.
• Once the Seller confirms the replacement, the original item must be returned before the replacement is dispatched (unless the Seller opts for replacement without collection).
• On special sale days designated by Gadget Guruz (e.g. promotional events), separate return and replacement policies may apply and will be communicated on the Platform.

• All payments are processed by Razorpay Software Pvt Ltd, an RBI-authorised Payment Aggregator. Gadget Guruz does not store your card number, CVV, UPI PIN, or bank credentials.
• By making a payment, you authorise us (and Razorpay) to process the transaction on your behalf.
• In the event of a failed or erroneous transaction, any amount debited will be refunded to your original payment method within 5–7 working days, subject to bank processing times.
• Pricing is in Indian Rupees (INR) and inclusive of applicable taxes unless stated otherwise.
• We reserve the right to modify pricing at any time. Changes do not affect already-confirmed orders.

• Gadget Guruz offers a limited warranty on repair services for the period specified at service completion. The warranty covers the specific repair carried out only.
• The warranty is void if: (a) the device suffers physical or liquid damage after repair; (b) the device is repaired or tampered with by a third party; or (c) the issue is unrelated to the original repair.
• For marketplace products, any manufacturer warranty continues under its original terms. Gadget Guruz does not provide an additional warranty on marketplace products unless explicitly stated.

You agree that you will not use the Platform to:

• Violate any applicable law, regulation, or order of a competent authority.
• Submit false, misleading, or fraudulent orders, listings, or information.
• List stolen, counterfeit, prohibited, or legally restricted devices for sale.
• Circumvent or manipulate our pricing, offer, referral, or promotional systems.
• Interfere with, disrupt, or damage the Platform, its servers, or any connected systems.
• Use bots, scrapers, or automated tools to access or extract data without our prior written consent.
• Impersonate Gadget Guruz, a Gadget Guruz employee, or any other user.
• Engage in any conduct that could expose Gadget Guruz to civil or criminal liability.

• All content on the Platform — including the Gadget Guruz name and logo, SERKIT, PRAMAAN, Saarthi, website design, text, graphics, software, and diagnostic models — is the exclusive intellectual property of Gadget Guruz Technologies Pvt Ltd.
• We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for personal or internal business purposes only.
• You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any part of the Platform without our prior written consent.
• If you submit feedback, suggestions, or ideas regarding our services, you grant us a perpetual, irrevocable, royalty-free licence to use and incorporate that feedback without any obligation to you.

The Platform may contain links to third-party websites or integrate with third-party services (including Razorpay, Google, Facebook, and logistics partners). These third parties operate under their own terms and privacy policies. Gadget Guruz is not responsible for the content, accuracy, or data practices of any third-party service. Your use of third-party services is at your own risk.

Your personal data is collected and processed in accordance with our Privacy Policy, compliant with the Digital Personal Data Protection (DPDP) Act, 2023 and the IT (Reasonable Security Practices) Rules, 2011.

• We do not sell your personal data to third parties.
• KYC data collected from service partners is used solely for identity verification and payouts.
• Payment credentials are processed exclusively by Razorpay and are never stored on our servers.
• You may exercise your rights under the DPDP Act (access, correction, erasure, grievance) by contacting privacy@gadgetguruz.com.
• We will acknowledge data requests within 48 hours and resolve them within 30 days.

The Platform and all Services are provided "AS IS" and "AS AVAILABLE" without any warranty of any kind. To the extent permitted by applicable law, Gadget Guruz expressly disclaims:

• Any warranty that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.
• Any warranty regarding the accuracy, completeness, or reliability of any diagnostic result, health score, or device certification generated through PRAMAAN.
• Any warranty of fitness for a particular purpose or merchantability with respect to any product or service on the Platform.

To the maximum extent permitted by applicable law, Gadget Guruz Technologies Pvt Ltd shall not be liable for:

• Any indirect, incidental, special, or consequential loss or damage arising from your use of the Platform or Services.
• Any loss of data, revenue, profit, or business opportunity arising from service delays, interruptions, or errors.
• Any loss or damage to your device while in transit (beyond our reasonable control and standard transit insurance cover, if applicable).
• Any claims arising from transactions between Buyers and Sellers on the marketplace, where Gadget Guruz acts only as an intermediary.

Nothing in these Terms limits liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

You agree to indemnify, defend, and hold harmless Gadget Guruz Technologies Pvt Ltd, its directors, officers, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising from:

• Your breach of these Terms.
• Your violation of any third party's rights, including intellectual property or privacy rights.
• Your violation of any applicable law.
• Any content or information you submit to or through the Platform.

If you wish to delete your Gadget Guruz account and all associated personal data, please follow the instructions at Account Deletion Instructions. Upon deletion:

• All personal data will be permanently deleted in accordance with our Privacy Policy and data retention schedule.
• Any pending orders or active service requests must be resolved before account deletion can be completed.
• Any unused wallet balance or credits must be redeemed or refunded before deletion.
• KYC documents and transaction records will be retained for the periods required by applicable financial regulations before permanent deletion.

These Terms and all disputes arising from them are governed by the laws of India. The Consumer Protection Act, 2019, the Information Technology Act, 2000, and the Contract Act, 1872 apply where relevant.

Before initiating any formal legal proceeding, you agree to contact us at support@gadgetguruz.com with a written description of your dispute. We will attempt to resolve it informally within 30 days.

If informal resolution is unsuccessful, all disputes shall be subject to the exclusive jurisdiction of the competent courts located in New Delhi, India.

Nothing in these Terms limits your rights under the Consumer Protection Act, 2019. You retain the right to approach the National Consumer Helpline (1800-11-4000) or the relevant Consumer Disputes Redressal Commission.

Continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised Terms.
